1. Acceptance of Terms

By accessing or using FRUIT MAFIA (the "Game"), operated by Fruit Mafia Games ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Game.

2. Description of Service

FRUIT MAFIA is a fictional strategy conquest game. All activities depicted within the game are entirely fictional and intended solely for entertainment purposes. The game involves a virtual credit-based economy, in-game asset licensing, and competitive gameplay elements.

3. Account Registration & Platform Linking

You must provide accurate information when creating an account. You must be at least 18 years old to use this service.

Identity Mapping: To receive rewards from third-party platforms, you must successfully link your Kick.com username and/or Stripe identity to your FRUIT MAFIA account. We are not responsible for rewards lost due to incorrect account linking by the User.

4. Virtual Currency ("Credits")

The Game utilizes a virtual currency known as "Credits."

• Acquisition: Credits can be obtained through (a) direct purchase via Stripe, (b) gifting of subscriptions or subscribing on the Kick platform, or (c) earned as commissions through the Affiliate Program.
• No Cash Value: Credits are a limited, non-transferable, and revocable license for use solely within the Game. They have no "real-world" monetary value and do not constitute a personal property right or a bank deposit.
• Finality of Sales: All purchases of Credits (whether via Stripe or Kick) are final and non-refundable. Any attempt to "Chargeback" or dispute a legitimate transaction will result in an immediate and permanent ban of your FRUIT MAFIA account and forfeiture of all associated virtual assets.

5. 2-Tier Affiliate & Referral Program

Users may earn "Commission Credits" by referring new Users to the Game.

• Two-Tier Structure: Commissions are earned on two levels:
  • Tier 1 (Direct): 60% of the purchase value goes to your direct Warlord.
  • Tier 2 (Indirect): 15% goes to the Tier 2 Warlord (upline). FRUIT MAFIA retains 25%.
• Payouts: To "Cash Out" Commission Credits for real-world currency, a User must (a) have a verified Stripe account connected to their Dashboard, (b) reach a minimum balance of 5,000 Credits ($50 USD equivalent), and (c) be in good standing with no active violations.
• Anti-Abuse: Self-referral, creating multiple accounts to farm commissions, or using automated scripts to generate referrals is strictly prohibited and will result in a permanent ban and seizure of all earned commissions.

6. Marketplace & AI Assets

Items purchased in the Marketplace, including Weapons, Vehicles, and "AI Crew Members," are digital licenses for use within the FRUIT MAFIA simulation.

Maintenance Tiers: Certain high-level assets (e.g., "Spy" or "Enforcer") may require an active monthly Credit balance or a recurring Stripe subscription. If a subscription is cancelled or a balance fails, the asset will be deactivated in-game until the status is restored.

7. Anti-RMT & Asset Trading Restrictions

Real-Money Trading (RMT) Prohibited: You may not sell, trade, exchange, or otherwise transfer any in-game Credits, items, garrisons, territory rights, or other virtual assets for real-world currency or value outside of the FRUIT MAFIA ecosystem and its official Stripe Connect payout system.

• All revenue-sharing payouts (60%/15%) must flow exclusively through Stripe Connect as configured by FRUIT MAFIA.
• Offering or soliciting out-of-game trades (PayPal, Venmo, crypto, gift cards, etc.) for in-game assets is strictly prohibited.
• Advertising RMT services in-game, on Kick streams, or on social media while referencing FRUIT MAFIA assets will result in permanent account termination.
• Violations result in immediate account termination, forfeiture of all Credits, pending commissions, and virtual assets — no exceptions.

8. Prohibited Conduct

You agree not to:

• Use automated scripts, macros, or bots to play the game or manipulate the economy.
• Exploit bugs or glitches for unfair advantage.
• Harass, threaten, or abuse other players or staff.
• Attempt to "launder" credits through fraudulent gift-sub patterns on third-party platforms.

9. Third-Party Platforms

FRUIT MAFIA integrates with Google (account authentication), Kick.com, and Stripe.com. By using these features, you agree to be bound by their respective Terms of Service:

• Google OAuth: We use Google as an identity provider for account creation and login. Google provides your email, name, and profile picture for this purpose. You can disconnect Google sign-in at any time via your Google account settings. Google use of information received from Google APIs will adhere to the Google API Services User Data Policy.
• Kick.com: We verify your public subscription status via the Kick API to grant in-game Credits.
• Stripe.com: All payment processing and affiliate payouts are handled through Stripe.

We are not liable for account actions, bans, or financial disputes occurring on Google, Kick, or Stripe that may impact your FRUIT MAFIA account.

10. Termination

We reserve the right to suspend or terminate accounts at our discretion. Upon termination for cause, all virtual items, Credits, and pending commissions are forfeit.

11. Limitation of Liability

Fruit Mafia Games is not liable for any indirect, incidental, or consequential damages arising from your use of the Game. Our total liability shall not exceed the amount you paid in the preceding 12 months.

12. Changes to Terms

We may modify these terms at any time. Continued use of the Game constitutes acceptance of revised terms.
